1. Scope and company
Mosey is operated by Moseyaround Limited, a company incorporated in England and Wales. This United States Regional Legal Notice supplements our Terms & Conditions, Privacy Policy, Cookie & App Technologies Policy, Rewards Terms and other documents in the Mosey Legal Centre for users in the United States.
Moseyaround Limited remains the contracting entity unless we expressly identify a different entity for a particular US service.
2. US availability, currency and rewards
Features, promotions, reward partners, gift cards, redemption values and availability may differ between the United Kingdom and the United States. US visitors are shown US-specific reward information and US dollars where available.
Gift cards and other rewards are separate regional products. A UK reward is not automatically exchangeable for a US reward and currency values are not automatically converted using foreign-exchange rates. The reward catalogue shown at the time of redemption governs availability.
Mosey Acorns are promotional loyalty units, not money, deposits, stored value, securities or cryptocurrency. They have no cash value except where expressly stated in a specific promotion or where applicable law requires otherwise.
3. United States Privacy Notice
This section supplements Mosey’s main Privacy Policy for United States consumers. When your selected or detected Mosey region is the United States, this section explains our US personal-information practices and applicable state privacy choices. If this section conflicts with UK-specific wording in the main Privacy Policy, this US section controls for the US service to the extent required by applicable law.
Moseyaround Limited is the business/controller responsible for the personal information described here. The substantive account, rewards, activity, advertising, offerwall, analytics and fraud-prevention processing described in this US notice relates primarily to the Mosey mobile application and related account services. The public Mosey website is a static informational website and does not currently use advertising cookies, tracking pixels, behavioural analytics or similar technologies to sell or share visitor personal information or use it for targeted advertising. Basic network/security delivery by the hosting/CDN provider may still involve technical information such as IP addresses for delivery and security purposes. Separate Washington and Nevada consumer-health-data policies apply where those laws cover app activity information. Mosey’s US privacy choices page explains universal opt-out signals such as Global Privacy Control in the context of the current static website and app.
3.1 Categories of personal information
Depending on the features you use, Mosey may collect or process:
- Identifiers and account data: name/display name, username, email address, internal account/user ID, authentication identifiers and account status.
- Structured member data: display name/username, account preferences, challenge/leaderboard/referral records and communications you send directly to Mosey support. Mosey does not provide profile photos, biographies, free-text posts/comments, media uploads, public feeds or direct/private member messaging.
- Internet, device and network information: IP address, device/browser type, operating system, app version, device or advertising identifiers where enabled, diagnostic logs, crash information, security events and website/app interaction information.
- Approximate location and regional information: country/region derived from network information, selected country, and postcode or coarse location where a feature asks for it. Mosey does not need precise geolocation for ordinary reward use unless a specific feature clearly requests it.
- Activity information: step/activity totals, dates/timestamps, source information and activity-derived reward/integrity records where you enable supported activity integrations. Washington and Nevada residents should also read our separate consumer-health-data policies.
- Commercial/reward information: Acorn earning records, reward eligibility, redemptions, gift-card/reward selections, referral/challenge records and fulfilment status.
- Fraud, security and integrity information: account-linking signals, suspicious activity indicators, VPN/proxy/location-circumvention indicators, duplicate-account indicators and records of investigations or enforcement.
- Support and communications: messages to support/privacy/legal teams, complaint records, survey responses and transactional communications.
- Advertising/analytics information: where enabled and permitted, identifiers and interaction information used to serve, measure or attribute advertising, offers or analytics. HealthKit and Health Connect activity data is excluded from advertising/offerwall targeting or profiling.
3.2 Sources
We obtain information directly from you; from your device, browser and Mosey app; from Apple/Google authentication and supported health/activity interfaces when you authorize them; from service providers operating on our behalf; from advertising, offerwall or attribution partners where enabled; from reward-fulfilment providers; and from records created through your use of Mosey.
3.3 Purposes
We use personal information to create and authenticate accounts; provide app and website functionality; display activity; calculate Acorns, daily rewards and Step Multiplier eligibility; administer challenges and referrals; fulfil rewards; communicate with you; provide support; detect fraud, VPN/proxy circumvention and abuse; protect security; diagnose and improve the service; measure service performance; comply with law; establish or defend legal claims; and, where permitted and appropriately disclosed, provide or measure advertising and partner offers.
4. Disclosure and third-party categories
We may disclose personal information to categories of recipients including:
- cloud hosting, database, authentication, security and infrastructure processors;
- analytics, diagnostics and crash-reporting providers;
- communications and transactional-email providers;
- reward/gift-card fulfilment providers where needed to complete a redemption;
- advertising, attribution and offerwall providers where those features are enabled and permitted;
- professional advisers, auditors and insurers where necessary;
- government, law-enforcement or regulatory bodies where disclosure is legally required or permitted; and
- a purchaser, successor or adviser in a merger, financing, restructuring or sale, subject to applicable law.
The categories disclosed depend on the service. Account identifiers, device/network information, usage information, reward/transaction records, support information and fraud/security information may be disclosed where necessary for the relevant purpose. Raw Apple Health/HealthKit and Health Connect activity data is not provided to advertising networks, advertising SDKs or offerwall providers for advertising, targeting or profiling.
5. Sale, sharing, targeted advertising and Your Privacy Choices
Mosey does not sell personal information for money. However, under some US privacy laws, making identifiers or online activity available to advertising or attribution partners can be defined as a “sale,” “sharing,” or processing for “targeted advertising” even where no money changes hands. We therefore do not make an absolute “we never sell or share” representation when such technology is enabled.
Where applicable law gives you an opt-out right, use Your US Privacy Choices or contact [email protected]. Where required, the control applies to sale/sharing and targeted advertising and will not require you to create a new account.
Static website and universal opt-out signals: the public Mosey website does not currently perform sale/sharing or targeted-advertising processing for a Global Privacy Control or similar browser signal to disable. If Mosey later introduces website advertising, tracking or other processing that is subject to a legally required universal opt-out mechanism, we will implement the applicable mechanism before or when that processing begins.
App privacy choices: privacy choices concerning advertising, attribution or targeted-advertising processing in the Mosey app are handled through the app/account privacy controls and the request methods described in Your US Privacy Choices, as applicable to the technology and state law involved.
6. Sensitive personal information
Some state laws classify precise geolocation, account credentials and certain health-related information as sensitive. Mosey limits sensitive-data processing to purposes reasonably necessary and proportionate to provide requested features, maintain security, prevent fraud or satisfy law, and obtains consent where an applicable state law requires consent.
We do not use HealthKit or Health Connect activity data to infer diagnoses or medical conditions for advertising, and we do not provide that data to advertising or offerwall providers for advertising, targeting or profiling. Washington and Nevada residents should read the separate Washington and Nevada consumer-health-data policies.
7. Static website and mobile-app technologies
Public website: Mosey’s public website is statically published and does not currently use advertising cookies, tracking pixels, behavioural advertising SDKs or similar technologies to profile visitors or sell/share visitor personal information for targeted advertising. We therefore do not display a consent banner merely to obtain consent for tracking that the website does not perform. Essential hosting, content delivery and security functions may process technical network information where necessary to deliver and protect the site.
Mosey app: the mobile application may use SDKs and similar technologies for authentication, security, crash diagnostics, analytics, advertising, attribution, rewarded ads and offerwall functionality. App processing is disclosed in this notice and, where required, choices or consent are presented in the app or account experience. Apple Health/HealthKit and Health Connect activity data is not provided to advertising or offerwall providers for advertising, targeting or profiling.
8. US state privacy rights
Depending on your state, applicable thresholds and legal exceptions, you may have rights to:
- know or confirm whether we process personal information about you and obtain access to it;
- request categories and/or specific pieces of personal information and information about sources, purposes and disclosures;
- correct inaccurate personal information;
- delete personal information;
- obtain a portable copy of qualifying personal information;
- opt out of sale, sharing, targeted advertising or certain profiling;
- limit certain uses/disclosures of sensitive personal information where the right applies;
- withdraw consent where processing relies on consent;
- appeal a denied request where state law provides an appeal right; and
- receive equal service and not be unlawfully discriminated against for exercising privacy rights.
To exercise a right, use Your US Privacy Choices or email [email protected] and state your US state of residence and requested right. We may authenticate the request using information reasonably necessary to protect your account and data. We will not require you to create a new account solely to make a request.
Where permitted, an authorized agent may submit a request for you. We may require evidence of the agent’s authority and may ask you to verify your identity or confirm permission directly unless applicable law provides otherwise.
9. California disclosures
For California consumers, the categories described in section 3.1 may correspond to CCPA categories including identifiers; customer-record information; commercial information; internet or other electronic-network activity; geolocation information at an approximate/coarse level where collected; and inferences or sensitive personal information to the extent a particular item meets those statutory definitions.
During the preceding 12 months, the categories collected, sources, business/commercial purposes and recipient categories are described in sections 3 and 4 above. We do not sell personal information for money. If app advertising or attribution disclosures constitute “sharing” or “sale” under the CCPA and the CCPA applies to Mosey, California consumers may use the applicable app/account privacy choice and Your US Privacy Choices. The static public website does not currently perform such sale/sharing processing. If that website practice changes, Mosey will implement any required qualifying opt-out preference signal handling before or when the processing begins. We do not knowingly sell or share the personal information of consumers we know are under 16; Mosey accounts are intended for adults aged 18 or over.
California consumers may exercise applicable rights to know/access, delete, correct, opt out of sale/sharing, limit use/disclosure of sensitive personal information where the statutory right applies, and receive non-discriminatory treatment. We will handle requests and verification in accordance with the CCPA and applicable regulations.
Mosey may operate a bona fide rewards programme. Participation in the rewards programme is governed by the Rewards Terms. If a practice constitutes a financial incentive or price/service difference requiring a California Notice of Financial Incentive, Mosey will provide that notice at or before enrolment in the relevant programme or feature and obtain any consent required by law.
10. Retention, security and international processing
We retain each category of personal information only for as long as reasonably necessary for the disclosed purpose, taking account of account status, reward and fraud records, legal limitation periods, security needs, tax/accounting obligations and legal retention requirements. We do not retain personal information indefinitely merely because it may be useful in the future.
We maintain administrative, technical and organizational safeguards appropriate to the nature and volume of information processed. No system can be guaranteed absolutely secure.
Moseyaround Limited is a United Kingdom company. US personal information may therefore be processed in the United Kingdom and by service providers in the United States or other countries. We use contractual and other safeguards appropriate to the service and applicable law.
11. Changes, annual review and contact
We review this US privacy notice at least annually and update it when our practices or applicable requirements materially change. Where law requires notice or consent before a materially different use of previously collected information, we will provide it before beginning that processing.

12. Age restriction
Mosey is intended only for adults aged 18 or over. We do not knowingly permit people under 18 to create an account. If we learn that an account is held by someone under 18, we may suspend or close the account and delete associated information where appropriate, subject to legal retention requirements.
13. US Fair Play & Anti-Cheat Supplement
The master Fair Play & Anti-Cheat Policy applies to US members together with this supplement. Enforcement must remain proportionate and subject to applicable federal and state consumer law.
VPNs and location tools: using a VPN for ordinary privacy/security is not automatically cheating. It becomes prohibited where it is used to evade US residency, state, offerwall, advertising, promotion, reward or other eligibility restrictions, conceal duplicate accounts, or otherwise obtain an advantage for which the member is not eligible.
Automated detection and human review: automated fraud scores, device signals and anomaly detection may trigger a temporary hold or investigation. They will not, by themselves, make a final decision to permanently terminate a US account or forfeit legitimately redeemable value. A human review is required before such a decision takes effect.
Reason for material enforcement: Mosey will normally identify the general category of conduct found — for example activity manipulation, multiple accounts, referral abuse, offer/reward abuse or regional/VPN circumvention — while retaining the right to protect confidential detection methods, third-party information and security controls.
Appeal and restoration: a US member may appeal material enforcement. Where a decision is reversed, Mosey will restore the appropriate eligible Acorns, reward status or account access where technically possible.
14. United States Rewards Terms
These United States Rewards Terms supplement the master Rewards Terms when your selected or detected Mosey region is the United States. If this section conflicts with UK-specific reward wording, this US section controls for the US programme. The Terms & Conditions and Fair Play & Anti-Cheat Policy also apply.
15.1 Acorns and current standard redemption
Mosey Acorns are promotional loyalty points used within the Mosey rewards programme. They are not money, a bank deposit, stored value, cryptocurrency or a security and cannot be transferred, sold or exchanged for cash except where applicable law requires otherwise.
The current standard US redemption is 15,000 Acorns for one US $5 gift card. The minimum standard redemption is therefore currently US $5. Gift-card brands and stock vary and the catalogue shown in the app at redemption is the current catalogue.
15.2 Earning Acorns and the daily Step Multiplier
The app displays the activities that award Acorns and any daily limits that apply. Mosey may award Acorns for eligible steps, games, challenges, referrals, rewarded advertising, partner offers or other disclosed activities.
The daily Step Multiplier applies to eligible Acorns earned during that same day in accordance with the multiplier tier reached from the member’s eligible daily steps. It does not multiply an existing account balance or Acorns earned on previous days. The app displays the current multiplier tiers, limits and calculation rules. Where the multiplier applies to all Acorns earned that day, the app will calculate the day’s eligible Acorns and then apply the applicable percentage boost to that daily amount.
15.3 No guaranteed earning time or reward
Mosey does not guarantee that a member will earn a particular gift card within a particular number of days or weeks. Earning speed depends on eligible activity, available earning features, daily limits and programme rules. The app should display current earning rates, relevant daily caps, the current minimum redemption threshold and the terms of individual earning activities so that members can make an informed decision before participating.
15.4 US annual redemption cap
A US member may currently redeem no more than US $600 in aggregate retail reward value in a calendar year. This is a Mosey programme, fraud-prevention and risk-management limit. It is not represented as the federal Form 1099-MISC reporting threshold. The cap applies across the member’s Mosey account and any duplicate or linked account identified as belonging to the same person.
Reaching the annual cap prevents further US redemptions for the remainder of that calendar year but does not, by itself, remove legitimately earned Acorns. Ordinary balance, inactivity and account rules continue to apply.
15.5 Taxes
Rewards may be taxable to a member depending on the facts and applicable federal, state or local law. Members are responsible for their own tax obligations. Mosey may request information, withhold amounts, make reports or provide tax forms where required by law. A tax reporting threshold is not the same as a tax-free allowance and does not determine whether a reward is taxable.
15.6 Reward availability and fulfilment
Gift cards and other rewards are subject to supplier availability, geographic restrictions and the terms of the relevant issuer. A reward is not guaranteed until the redemption has been accepted and successfully fulfilled. If a selected reward becomes unavailable before fulfilment, Mosey may offer an equivalent-value available reward, restore the relevant Acorns, or provide another lawful remedy. Mosey will not substitute a lower retail value without the member’s agreement.
Unless a specific reward states otherwise, US rewards are intended for use in the United States and may be subject to the issuer’s own redemption restrictions.
15.7 Changes to rates, thresholds and programme limits
Mosey may change earning rates, multiplier tiers, redemption thresholds, reward catalogue, programme limits or other reward economics for valid reasons including supplier pricing or availability, fraud/abuse, legal or tax requirements, security or technical changes, material operating-cost changes, or maintaining the economic sustainability of the programme.
For a materially adverse change affecting already-earned Acorns, Mosey will ordinarily provide at least 30 days’ advance notice and, where reasonably possible and lawful, allow eligible members to redeem during that notice period under the previous threshold. Immediate action may be necessary for law, security, fraud, supplier failure or circumstances outside Mosey’s reasonable control.
15.8 Fair play, VPNs and invalid rewards
Acorns must be earned legitimately. Prohibited conduct includes falsifying or manipulating activity; automated or artificial steps; exploiting bugs; multiple/duplicate accounts; referral abuse; false residence or identity information; and use of a VPN, proxy, emulator, location spoofing or similar technique to circumvent country, offer, advertising, reward or eligibility restrictions.
Mosey may place suspicious Acorns or redemptions on temporary hold while they are reviewed and may remove Acorns that were demonstrably awarded incorrectly or obtained through prohibited conduct. Permanent termination or forfeiture of legitimately redeemable value for suspected fraud will receive human review and an appeal route as described in the Fair Play & Anti-Cheat Policy.
15.9 Account deletion, inactivity and state law
If a member requests account deletion while holding an eligible balance at or above the current minimum redemption threshold, Mosey will, where lawful and technically possible, provide a 14-day opportunity to redeem before closure, subject to normal verification, fraud checks and programme limits. Exercising a privacy right does not itself impose a penalty.
Any inactivity, dormancy, expiry or forfeiture provision applies only to the extent permitted by the member’s state law. Applicable unclaimed-property, gift-card, stored-value or similar mandatory law prevails where it requires different treatment.
15.10 No purchase, stake or wager
Ordinary participation in Mosey reward earning and games does not require a purchase, deposit, stake or wager. Acorns cannot be staked or wagered. Payment does not improve the odds of a chance-based outcome. Mosey may restrict or modify a game or promotion in a jurisdiction where applicable law requires different rules.
15.11 Errors, reversals and appeals
If Mosey makes a reward or Acorn accounting error, we may correct the error and will keep a record sufficient to explain the adjustment. If a redemption is refused or reversed because of suspected prohibited conduct, the member may use the applicable appeal process. If Mosey determines that an enforcement decision was wrong, we will restore the appropriate eligible balance or reward status where technically possible.
15.12 California financial-incentive notice
Mosey’s rewards programme is designed to reward eligible activity and engagement, not to pay members for allowing Mosey to sell their personal information. If, based on the programme’s actual US data practices and applicability thresholds, California law requires Mosey to treat a feature as a financial incentive or price/service difference tied to the collection, deletion or sale of personal information, Mosey will provide the required Notice of Financial Incentive at or before opt-in, including the material terms, implicated data, withdrawal method and the legally required good-faith value explanation.
15. United States Terms & Conditions
This section is the United States supplement to the Mosey Terms & Conditions. When your Mosey region is the United States, this section applies together with the master Terms. If a provision of this US section conflicts with UK-only wording in the master Terms, this US section controls for the United States service. Mandatory federal or state consumer law continues to apply.
15.1 Eligibility and geographic availability
You must be at least 18 years old and a resident of the United States to create or use a US Mosey account. Mosey may exclude a state or territory where the service or a particular reward cannot lawfully or practically be offered. Any current exclusion will be disclosed before account creation or use of the affected feature. You must not select or use the US region if you are not a US resident, and you must not use a VPN, proxy, location-spoofing technology or false account information to circumvent regional availability, reward restrictions or eligibility controls.
15.2 Rewards, Acorns and annual US redemption limit
Acorns are in-app reward points, are not legal tender, are not a bank deposit and have no cash value except to the limited extent that an eligible member may exchange the required number for an available reward under the Rewards Terms. Reward brands, denominations, Acorn thresholds and availability may vary by region and may change for valid commercial, supplier, legal, tax, fraud-prevention or operational reasons in accordance with the notice protections in the master Terms and Rewards Terms.
US redemptions are currently capped at an aggregate retail reward value of US $600 per member per calendar year. This is a Mosey programme limit and fraud/risk control, not a statement that US tax law requires a $600 cap. We may apply a lower limit where required by law, supplier rules or a disclosed promotion. We will not increase the cap for an individual by allowing duplicate or linked accounts.
Rewards may constitute taxable income depending on your circumstances. You are responsible for your own tax obligations. Mosey may request tax information, withhold, report or issue information returns where required by applicable law. A reporting threshold does not determine whether an amount is taxable.
15.3 Free participation; no stakes or wagering
Participation in Mosey games and ordinary reward-earning activities does not require a stake, deposit, wager or purchase. Acorns cannot be wagered or staked on an outcome. Payment does not improve the odds of a chance-based outcome. Where a particular US jurisdiction requires a different game mechanic, eligibility restriction or alternative method of participation, Mosey may modify, restrict or disable that feature in that jurisdiction.
15.4 Fair play, VPNs, fraud and incorrectly awarded Acorns
You must not manipulate step or activity data; automate or falsify activity; exploit bugs; operate duplicate accounts; abuse referrals; submit false identity or residence information; use a VPN, proxy or location-spoofing service to evade regional or offer eligibility; interfere with fraud controls; or otherwise obtain Acorns or rewards dishonestly or contrary to the Fair Play & Anti-Cheat Policy.
Where there is a reasonable basis to believe Acorns were incorrectly, fraudulently or abusively obtained, Mosey may place a temporary hold on redemption while the matter is reviewed. Incorrectly awarded Acorns may be removed. Permanent account termination or forfeiture of legitimately redeemable value for suspected fraud will not take effect solely on an automated fraud score: the decision will receive human review. Where action is taken, we will identify at least the general category of conduct involved (for example activity manipulation, multiple accounts, referral abuse or regional/VPN circumvention), unless greater disclosure would create a material security, legal or fraud-prevention risk. You may use the appeal process in the Fair Play Policy.
15.5 Account deletion and inactivity
Exercising an applicable privacy right does not itself impose a penalty. If you request account deletion while holding a balance at or above the then-current minimum redemption threshold, we will, where lawful and technically possible, give you a 14-day opportunity to redeem eligible rewards before account closure, subject to ordinary verification, fraud checks and programme limits. This does not require Mosey to redeem Acorns that were incorrectly awarded, obtained through prohibited conduct or otherwise ineligible under the Rewards Terms.
Any US inactivity, dormancy, expiry or forfeiture rule applies only to the extent permitted by the law of your state. Where applicable unclaimed-property, gift-certificate, stored-value or similar law requires different treatment, that law controls.
15.6 Changes to reward economics or material terms
Mosey may change Acorn earning rates, redemption thresholds, reward availability, programme limits or other programme terms only for a valid reason, including supplier pricing or availability, fraud or abuse, legal or regulatory requirements, tax treatment, material changes in operating costs, security, technical changes or maintaining the economic sustainability of the rewards programme. For a materially adverse change affecting already-earned Acorns, we will ordinarily provide at least 30 days' advance notice and, where reasonably possible and lawful, a redemption opportunity under the previous threshold during that notice period. Immediate changes may be made where required by law, security, fraud prevention or circumstances outside our reasonable control.
15.7 Consumer rights
Nothing in the Mosey Legal Suite limits any right or remedy that cannot lawfully be waived under applicable United States federal law or the consumer protection law of your state. References in the master Terms to “statutory rights” should, for US members, be read as including applicable federal and state consumer rights.
15.8 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSEY AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED. WE DO NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, ERROR-FREE OR THAT EVERY THIRD-PARTY REWARD WILL REMAIN AVAILABLE.
SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. ANY WARRANTY THAT CANNOT LAWFULLY BE DISCLAIMED REMAINS IN EFFECT TO THE EXTENT REQUIRED BY LAW.
15.9 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSEYAROUND LIMITED WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICE. WHERE LIABILITY MAY LAWFULLY BE LIMITED, OUR AGGREGATE LIABILITY ARISING FROM THE EVENT GIVING RISE TO A CLAIM WILL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE RETAIL VALUE OF ELIGIBLE, REDEEMABLE REWARDS WRONGFULLY LOST AS A DIRECT RESULT OF THAT EVENT.
This limitation does not exclude liability that cannot lawfully be excluded or limited. Some states do not allow limitations or exclusions of incidental or consequential damages, so those limitations may not apply to you. If Mosey wrongly closes an account or removes eligible Acorns, you may appeal; where the decision is reversed, the appropriate account status or eligible balance will be restored where technically possible.
15.10 Indemnity
To the extent permitted by applicable law, you agree to indemnify Moseyaround Limited against third-party claims, losses and reasonable costs arising directly from your intentional unlawful conduct, fraud, infringement of another person's rights, or material breach of these Terms. This provision does not require you to indemnify Mosey for Mosey's own negligence, unlawful conduct or breach, and does not waive any non-waivable consumer right.
15.11 Governing law and disputes
These Terms are governed by the law of England and Wales. Nothing in this section deprives you of the protection of mandatory consumer protection law of the State in which you are resident or applicable United States federal law; such law applies in addition to these Terms and prevails to the extent of a conflict.
You may bring proceedings relating to these Terms or your use of Mosey in the courts of England and Wales or in a court of competent jurisdiction in the State in which you are resident. Moseyaround Limited will bring proceedings against you only in a court of competent jurisdiction in the State in which you are resident, except where applicable law requires otherwise.
These Terms do not contain a mandatory arbitration agreement, class-action waiver or jury-trial waiver.
15.12 Complaints
If you are dissatisfied with Mosey, contact [email protected]. Include your name, account email, a description of the issue and relevant supporting information. We will acknowledge complaints within five business days and aim to resolve them within 60 days. Using this process does not limit applicable federal or state rights or your right to bring legal proceedings.
15.13 California residents
For purposes of California Civil Code section 1789.3, the service provider is Moseyaround Limited, 66 Paul Street, London, EC2A 4NA, United Kingdom, telephone +44 7883 721050. Mosey is free to download and use unless a clearly disclosed optional paid feature is introduced.
California residents may direct complaints to the Complaint Assistance Unit of the Division of Consumer Services, California Department of Consumer Affairs. The current telephone number and postal address required by California law will be displayed in this notice and reviewed before publication and at least annually. You may also contact Mosey at [email protected].
16. Privacy requests and appeals
US privacy requests may be sent to [email protected]. Please state that your request relates to United States privacy rights and identify your state of residence. We may need to verify your identity before completing a request.
Where applicable law provides a right to appeal a decision on a privacy request, you may appeal by replying to our decision or emailing [email protected] with the subject “US Privacy Appeal”. We will respond within the period required by applicable law.
Authorised agents may submit requests where permitted by applicable law, subject to appropriate verification of authority.
17. Changes to this notice
We may update this regional notice as Mosey expands in the United States, as our data practices change, or as federal and state laws develop. Material changes will be reflected by an updated effective date and, where required, additional notice.
